Public Offer for the Vacadoo Service
This document is a public offer (the “Offer”) by the Operator of the Vacadoo service and sets out the terms on which access to the service is provided to any adult individual with full legal capacity.
1. Definitions
Service — the Vacadoo service, including the Telegram bot, the website, and related features.
Operator — the person providing the Service; contact details are provided in Section 17 of the Offer.
User — an individual using the Service.
Profile — a structured description of the User’s professional experience, skills, education, and preferences, built from the resume they have provided and their settings.
Digest — a personal selection of vacancies compiled by the Service as a result of automatically matching vacancies against the Profile.
Paid Feature — a feature or access provided for a fee on the terms shown to the User before payment.
Order — a Paid Feature selected by the User, with the price, access period, number of operations, and other material terms specified before payment.
Acceptance — the User’s full and unconditional acceptance of the Offer.
2. Subject of the Offer
2.1. The Operator provides the User with access to the Service, and the User uses the Service and pays for Paid Features on the terms of the Offer and the corresponding Order.
2.2. The Service is intended for job searching and may:
- accept resumes as a PDF file or as text;
- analyse the resume and build a Profile;
- automatically match the Profile against vacancies from publicly available sources;
- compile and send the User a personal Digest;
- at the User’s request, create a draft resume tailored to a selected vacancy;
- provide other features related to job searching.
2.3. The Service’s website is used to publish information about Vacadoo, arrange payment, and provide access to the account area (app.vacadoo.cv). The account area and the Telegram bot are equivalent surfaces for delivering the service: resume intake, the Digest, and document creation are available through either one.
2.4. The set of the Service’s features may change without prior notice to the User.
3. Acceptance of the Offer
3.1. Any of the following actions, taken after the User has been provided with a link to the Offer, constitutes Acceptance:
- starting or continuing to use the Telegram bot;
- uploading a resume or sending text for processing;
- activating trial access;
- placing and paying for an Order;
- any other action that the Service’s interface expressly designates as acceptance of the Offer.
3.2. Payment for an Order constitutes Acceptance of the Offer with respect to the corresponding Paid Feature.
3.3. By accepting the Offer, the User confirms that they:
- have read the Offer and the Privacy Policy;
- understand the purpose and limitations of the Service;
- are an adult and have the necessary legal capacity;
- provide accurate information and use their own resume or have a lawful basis for using it.
3.4. If the User does not agree with the Offer, they must not use the Service.
4. How the services are provided
4.1. After processing the resume, the Service builds a Profile and uses it for matching against vacancies.
4.2. The Digest is compiled, as a rule, once per day. The delivery time may change.
4.3. A Digest may contain no vacancies if no suitable options were found among the postings processed by the Service. The absence of vacancies in an individual Digest does not in itself mean that the service was not provided.
4.4. Vacancies are obtained from publicly available sources and are published by third parties. The Operator is not an employer, an employer’s representative, a recruitment agency, or a party to employment relationships.
4.5. The Operator does not guarantee:
- the availability of any particular number of vacancies;
- that every vacancy will meet the User’s expectations;
- that the original posting is still current, complete, or accurate;
- a response, an interview invitation, or employment.
4.6. Before applying, the User must read the original posting, verify the employer on their own, and clarify the material terms of the vacancy.
5. Automated processing and generated documents
5.1. Resume analysis, vacancy matching, and document creation are performed automatically, including with the use of artificial intelligence technologies.
5.2. Automatically generated results may contain errors, omissions, inaccurate conclusions, or poor wording, and are advisory in nature.
5.3. Before sending a resume created by the Service to an employer, the User must review it and edit it where necessary. The User is solely responsible for the content of the documents and information they send to third parties.
5.4. The Operator does not make hiring decisions and does not guarantee any outcome from using the generated documents.
6. User materials
6.1. Rights to the resume and other materials provided by the User remain with the User or the respective rights holder.
6.2. The User grants the Operator a non-exclusive right to use the provided materials only to the extent necessary for the operation of the Service, including resume analysis, Profile building, vacancy matching, and the creation of documents at the User’s request.
6.3. The User must not submit to the Service:
- materials they have no right to use;
- third parties’ personal data without a lawful basis;
- malicious files;
- unlawful materials or information that infringes third-party rights.
6.4. The User may use the documents created at their request for their own job search. Such documents are generated automatically, are not exclusive, and may be similar to results created for other users.
7. Trial access
7.1. Unless the Service’s interface states otherwise, trial access is granted once per Telegram account and ends upon the expiry of 3 calendar days or after 5 document generations have been used, whichever comes first.
7.2. Creating multiple accounts, using other people’s accounts, or taking other actions to obtain trial access repeatedly is prohibited.
7.3. The Operator may change the terms of trial access or stop providing it without prior notice.
8. Price and payment
8.1. The price, access period, contents of the Paid Feature, number of available operations, and other terms of the Order are shown to the User before payment and form part of the Offer.
8.2. Payment is made by a method available in the Service at the time the Order is placed. A payment link generated in the Telegram bot or in the account area may be used for this purpose.
8.3. Payments are processed by an engaged payment provider. The payment methods available are shown to the User when the Order is placed.
8.4. The Operator does not receive or store full bank card details. The payment provider passes to the Operator the information needed to confirm payment and grant access.
8.5. An Order is considered paid once the Operator receives confirmation of a successful payment from the payment platform.
8.6. Automatic renewal applies unless expressly stated otherwise in the plan’s terms.
8.7. The Operator may change prices and terms for future Orders without prior notice. The price of an Order that has already been paid is not recalculated.
9. Refunds
9.1. All payments are final and non-refundable, except in the following cases:
- the same payment was erroneously charged more than once;
- the cases provided for in Sections 9.4 (EU/EEA and UK customers) and 9.5 (US customers);
- a refund is mandatory under applicable law.
9.2. Unless mandatory provisions of law provide otherwise, no refund is made in connection with:
- non-use or partial use of paid access;
- the absence of suitable vacancies in one or more Digests;
- a subjective assessment of the quality of the matching or of a generated document;
- the User’s mistaken choice of plan, period, or number of operations;
- inaccurate or incomplete information in the User’s resume;
- termination of access due to a breach of the Offer.
9.3. Provision of a Paid Feature begins immediately after payment is confirmed. By making a payment, the User requests that the service begin immediately. For Users covered by EU/EEA or UK consumer law, this constitutes consent to the service starting before the cooling-off period expires (Section 9.4).
9.4. EU/EEA and UK customers. Such a User has the right to withdraw from the contract within 14 days of purchase without giving any reason (the “cooling-off period”) by notifying support@vacadoo.cv within that period. The refund is processed within 14 days of receiving the withdrawal notice. If the service started at the User’s request before the cooling-off period expired (Section 9.3), a proportionate amount for the services provided up to the withdrawal may be deducted from the refund.
9.5. US customers. A refund may be issued in the following cases:
- an unauthorized charge (with supporting documentation);
- technical unavailability of the Service exceeding 72 consecutive hours;
- cancellation of automatic renewal before the start of the next billing cycle.
9.6. Cancelling a subscription. If a plan includes automatic renewal, the User may cancel it at any time using the same method by which the subscription was set up (including via the Telegram bot’s menu) or by contacting support@vacadoo.cv. After cancellation no further charges are made; access remains until the end of the paid period. Cancellation does not by itself create a right to a refund for the current period.
9.7. A refund request is sent to support@vacadoo.cv. The request must include the Telegram ID or username, the date and method of payment, the amount, and information sufficient to identify the payment.
9.8. Where grounds exist, the refund is made by the same method used for the payment, provided the payment platform supports such a refund, and is processed in accordance with the policy of the relevant payment provider. The indicative crediting time is 5–10 business days; the actual time depends on the payment platform and the User’s bank.
9.9. The provisions of this Section do not override User rights that cannot be excluded by contract under applicable law.
10. Acceptable use
10.1. The User must use the Service lawfully and in good faith.
10.2. The User must not:
- interfere with the operation of the Service, circumvent restrictions, or attempt to gain unauthorised access;
- use automated means to extract data from the Service at scale without the Operator’s written permission;
- resell access to the Service or use it to provide services to third parties without the Operator’s permission;
- systematically distribute Digests or other outputs of the Service;
- use the Service or its materials to train artificial intelligence models without the Operator’s written permission;
- create additional accounts to obtain trial access repeatedly or to circumvent restrictions;
- impersonate another person;
- use the Service in a way that violates the law or third-party rights.
11. Intellectual property
11.1. Exclusive rights to the software, design, branding, structure, and original materials of the Service belong to the Operator or are used by the Operator on a lawful basis.
11.2. The User is granted a limited, non-exclusive, and non-transferable right to use the Service for their personal job search in accordance with the Offer.
11.3. Rights to third-party trademarks and names belong to their respective owners.
12. Restriction and termination of access
12.1. The Operator may temporarily restrict or terminate the User’s access to the Service if the User:
- breaches the Offer;
- poses a threat to the security or stability of the Service;
- uses the Service for unlawful or fraudulent purposes;
- has not paid for a feature that requires payment.
12.2. In cases requiring immediate action to protect the Service, Users, or third parties, access may be restricted without prior notice.
12.3. The User may stop using the Service at any time. The procedure for deleting personal data is set out in the Privacy Policy.
13. Service availability
13.1. The Operator takes reasonable measures to keep the Service running but does not guarantee its uninterrupted and error-free availability.
13.2. The operation of the Service may be temporarily limited due to updates, maintenance, failures of Telegram, payment platforms, vacancy sources, or other third-party services, legal requirements, or circumstances beyond the Operator’s reasonable control.
13.3. The Operator may change, suspend, or discontinue individual features of the Service without prior notice to the User.
14. Liability
14.1. The Operator and the User are liable in accordance with applicable law and the Offer.
14.2. The Operator is not liable for:
- the content, accuracy, and timeliness of third-party postings;
- the actions or decisions of employers;
- the consequences of the User’s interactions with employers and other third parties;
- errors in automatically generated results that the User did not review before use;
- disruptions caused by Telegram, payment platforms, vacancy sources, or other third-party services;
- indirect losses, lost profit, and lost opportunities, to the extent such liability may be excluded by law.
14.3. To the extent the law allows liability to be limited by contract, the Operator’s maximum liability under a specific Order does not exceed the amount the User paid for that Order.
14.4. The Operator is not liable for a failure to perform, or improper performance of, its obligations caused by circumstances beyond its reasonable control, except where such liability is preserved by law.
15. Personal data
15.1. The processing of personal data is governed by the Vacadoo Privacy Policy, which forms an integral part of the Offer.
15.2. The User may stop the processing of their data and delete their Profile in the manner provided for by the Privacy Policy. If the Service cannot operate without the corresponding data, its deletion ends the provision of the related features.
16. Changes to the Offer and dispute resolution
16.1. The Operator may amend the Offer. A new version is published on the Service’s website and takes effect on the date specified in it.
16.2. Continued use of the Service after a new version takes effect constitutes acceptance of the updated Offer.
16.3. Before going to court, the User sends a claim to support@vacadoo.cv. The Operator reviews the claim and responds within the period provided for by applicable law, or, where no such period is established, within 14 calendar days.
16.4. The Offer is governed by the law of the Operator’s country of registration, subject to mandatory rules that apply to the User regardless of the choice of law.
16.5. If any individual provision of the Offer is held invalid or unenforceable, this does not affect the remaining provisions.
